| dc.description.abstract | Статтю присвячено нагальним питанням, пов’язаним з гарантіями невтручання в особисте й сімейне життя та проблемам їх реалізації в кримінальному провадженні України. На підставі аналізу теорії пізнання проаналізовано положення щодо дотримання прав і свобод людини під час проведення допиту як слідчої (розшукової) дії. Звернено увагу й обґрунтовано положення щодо імунітету свідка під час допиту священика за обставинами довірчого спілкування віруючих зі служителями культу.Соблюдения принципа невмешательства в частную жизнь во время проведения допроса Статья посвящена актуальным вопросам, связанным с гарантиями невмешательства в личную и семейную жизнь и проблемам их реализации в уголовном производстве Украины. На основании анализа теории познания проанализированы положения по соблюдению прав и свобод человека во время допроса как следственного (розыскного) действия. Обращено внимание и обосновано положение об иммунитете свидетеля во время допроса священника по обстоятельствам доверительного общения верующих со служителями культа. Holding of the Principle of Non-interference into the Private Life During Interrogation Unfortunately, the observance of human rights in the practice of investigating criminal offenses has, unfortunately, not become an indispensable condition for the work of the organs of pre-trial investigation. Although the purpose of procedural activities at the pre-trial stage is to prevent any violation of human rights, it is difficult to immediately and completely eliminate cases of human rights violations during this specific activity. There may be several reasons for this, as an authorized officer makes important procedural decisions within a limited time frame, in the absence of the necessary information. Despite these circumstances, reducing the level of human rights violations to a certain minimum level is a task that in no way loses its relevance. The article is devoted to topical issues related to guarantees of non-interference in personal and family life and problems of their implementation in the criminal production of Ukraine, taking into account generally recognized principles. Based on the analysis of the provisions of the theory of knowledge, the provisions on the observance of human rights and freedoms during interrogation as an investigative action are analyzed. The provision on immunity of the witness of the priest is justified. The purpose of this article is to study the issue of determining the institution of non-interference in private and family life in the criminal proceedings of Ukraine, generalizing the problems identified and developing scientifically substantiated recommendations for the improvement of criminal procedural legislation on the system of guarantees of ensuring the right of a person to non-interference in her personal and family life during interviewing. | uk_UA |
