Abstract
У статті визначаються проблемні питання організації досудового розслідування в контексті судової реформи України. На підставі аналізу законодавства, наукових розробок у галузі кримінального процесу, судово-слідчої практики здійснюється аналіз окремих змін до Кримінального процесуального кодексу України, внесених відповідно до Закону України «Про внесення змін до Господарського процесуального кодексу України, Цивільного процесуального кодексу України, Кодексу адміністративного судочинства України та інших законодавчих актів» від 3 жовтня 2017 року. Констатується, що зміни процесу досудового розслідування через судову реформу призводять фактично до його формалізації. Робиться висновок стосовно необхідності переосмислення організаційних засад діяльності слідчого та прокурора через принципіальну зміну процесу доказування на стадії досудового розслідування. In the article the problem questions of organization of to judicial investigation in the context of judicial reform of Ukraine are determined. On the basis of analysis of legislation, scientific developments in industry of criminal procedure, to practice judicial and investigation the analysis of separate changes of the Criminal judicial code of Ukraine is carried out. These changes are borne by Law of Ukraine “About bringing of changes in the Economic code of practice of Ukraine, Civil code of practice of Ukraine, Code of the administrative legal proceeding of Ukraine and other legislative acts” accepted оn October, 3, 2017. Establish about that the changes of process of legal regulation investigation within the framework of judicial reform result in his formalization actually. Conclusion in relation to the necessity of sense of organizational bases of activity of investigator, public prosecutor and investigation judge in connection with the change of process of proving of principle on the stage of legal regulation investigation is drawn.
