Abstract
Дослідження присвячене процесу втілення норми Європейського Союзу (далі - ЄС) у національне законодавство України враховуючи досвід держав-членів ЄС. Вступ до ЄС не можливий без зміни національного законодавства держави відповідно до рекомендацій ЄС. Дана вимога закріплена Європейською Радою у Копенгагенских і Мадридских критеріях, щодо членства у ЄС. Так звані «копенгагенські критерії» закріплюють процеси перебудови адміністративних структур держави і створення умов поступової гармонійної інтеграції в ЄС шляхом зміни національного законодавства відповідно до acquis communautaire (далі - acquis ЄС). Утім ЄС лишає за собою право визначати момент, коли він буде готовий прийняти нових членів. Слід відміти, що правопорядок кожної держави- члена ЄС є по своєму унікальним та супроводжується індивідуальним підходом в процесі імплементації норм ЄС. Держави не повинні порушувати власні принципи розвитку та конституційного ладу імплементуючи норми ЄС у національне законодавство. Кожна держава повинна обрати індивідуальний підхід поєднання та втілення норм, тому такий важливий досвід держав-членів ЄС для України. Процес імплементації є кропітким та складним, який має бути чітко врегульованим національним законодавством країни. Проаналізувавши досвід Польщі, Україна зможе знайти найефективніший спосіб імплементації норми ЄС у національне законодавство. У статті розглядається поняття та способи імплементації норми ЄС у національне законодавство. Наголошується на проблемах які виникають при здійсненні цього процесу. Проаналізовано національне законодавство України яке утворилося на основі співпраці з ЄС. Вивчено досвід Польщі щодо процесу втілення норм ЄС у національне законодавство та запропоновані шляхи вдосконалення процесу імплементації в Україні. Проаналізовано вітчизняні та європейські наукові дослідження присвячені процесу імплементації, зроблені логічні висновки та пропозиції. The study is devoted to the process of implementation of the norms of the European Union (hereinafter - the EU) into the national legislation of Ukraine, taking into account the experience of the EU member states. Accession to the EU is not possible without changing the state's national legislation in accordance with EU recommendations. This requirement is enshrined by the European Council in the Copenhagen and Madrid criteria for EU membership. The so-called "Copenhagen criteria" establish the processes of restructuring the administrative structures of the state and creating conditions for gradual harmonious integration into the EU by changing national legislation in accordance with the acquis communautaire (hereinafter - the EU acquis). However, the EU reserves the right to determine the moment when it will be ready to accept new members. It should be noted that the legal order of each EU member state is unique in its own way and is accompanied by an individual approach in the process of implementing EU norms.
States should not violate their own principles of development and constitutional order by implementing EU norms into national legislation. Each state must choose an individual approach to combining and implementing norms, which is why the experience of EU member states is so important for Ukraine. The implementation process is painstaking and complex, which must be clearly regulated by the country's national legislation. After analyzing Poland's experience, Ukraine will be able to find the most effective way of implementing EU norms into national legislation. The article examines the concept and methods of implementation of EU norms into national legislation. Emphasis is placed on the problems that arise during the implementation of this process. The national legislation of Ukraine, which was formed on the basis of cooperation with the EU, was analyzed. The experience of Poland regarding the process of implementation of EU norms into national legislation was studied and ways of improving the implementation process in Ukraine were proposed. Domestic and European scientific studies devoted to the implementation process were analyzed, logical conclusions and proposals were made.
