Abstract
У статті на підставі проаналізованих підходів до розуміння поняття та визначення сутності кримінально-виконавчої політики в України автору вдалось додатково аргументувати ряд доктринальних положень, що лежать в основі визначення фундаментальних категорій в аспекті означеної тематики. Доведено, що політикою в широкому державницькому розумінні є послідовність певних дій, реалізованих особою (особами), що мають конкретну мету та узгоджуються із загальними соціальними потребами певного суспільства, що утворило державу. Правова політика є складовою частиною державної політики, що пронизує законодавчими основами будь-яку сферу соціального буття. Кримінально-правова ж політика, як складова частина правової політики держави, перш за все регламентує механізм відбування покарання особами засудженими за вчинення правопорушень шляхом встановлення та унормування правового статусу останніх. In the article, based on the analyzed approaches to understanding the concept and defining the essence of penitentiary policy in Ukraine, the author was able to further argue a number of doctrinal provisions that underlie the definition of fundamental categories in terms of this topic. It is proved that politics in the broad state sense is a sequence of certain actions implemented by a person (persons) that have a specific purpose and are consistent with the general social needs of a particular society that formed the state. Legal policy is a component of public policy that permeates the legal framework of any sphere of social life. Criminal law policy, as a component of the legal policy of the state, first of all regulates the mechanism of serving a sentence for persons convicted of offenses by establishing and normalizing the legal status of the latter.
