| dc.description.abstract | Метою статті єаналіз актуальних проблем модернізації нормативної бази публічного адміністрування у сфері інтелектуальної власності в Україні, пов’язаних із законодавчим закріпленням питань адміністративної відповідальності за правопорушення в зазначеній сфері. Для її досягнення сформульовано такі завдання: проаналізувати наявні наукові підходи щодо адміністративної відповідальності за правопорушення у сфері інтелектуальної власності; обґрунтувати власну наукову позицію щодо внесення необхідних змін до чинного законодавства України про адміністративну відповідальність. Методологія підготовки публікації ґрунтується на застосуванні міжгалузевого підходу, який спонукає до досконалішого підходу до вивчення питання ролі законодавчого забезпечення адміністративно-правових засад публічного адміністрування у сфері інтелектуальної власності, аніж це було б зроблено лише в межах галузі публічного управління. Наукова новизна статті полягає в дослідженні можливості внесення відповідних змін до чинного вітчизняного законодавства про адміністративну відповідальність. Висновки. Актуальною проблемою модернізації нормативної бази публічного адміністрування у сфері інтелектуальної власності є виокремлення відповідних адміністративних правопорушень в окрему главу Особливої частини Кодексу України про адміністративні правопорушення. Новий структурний елемент Кодексу України про адміністративні правопорушення повинен базуватися на сучасній концепції охорони інтелектуальної власності й мати відповідну структуру, яка б відповідала вимогам сьогодення. Крім того, необхідним залишається й законодавче закріплення самої методики визначення розміру матеріальної шкоди за порушення прав інтелектуальної власності. The purpose of the article is to analyze the actual problems of modernization of the normative base of public administration in the field of intellectual property in Ukraine related to the legislative consolidation of issues of administrative responsibility for the offense in the field. For its achievement, the following tasks are formulated: to analyze the existing scientific approaches to administrative liability for offenses in the field of intellectual property; To substantiate its own scientific position on the introduction of necessary changes to the current legislation of Ukraine on administrative liability. The methodology of preparation of the publication is based on the application of inter-sectored approach, through which it is possible to be more likely to approach the study of the role of legislative provision of administrative and legal principles of public administration in the field of intellectual property than it would be made only within the field of public administration. The scientific novelty of the article is to study the possibility of making appropriate amendments to the current domestic legislation on administrative liability. Conclusions. The current problem of modernizing the normative base of public administration in the field of intellectual property is the allocation of relevant administrative offenses in a separate head of the special part of the Code of Ukraine on administrative offenses. The new structural element of the Code of Ukraine on administrative offenses should be based on the modern concept of intellectual property protection and to have a relevant structure that would meet the requirements of the present. In addition, the legislative consolidation of the methodology of determining the size of material damage to the violation of intellectual property rights remains. | uk_UA |
