Abstract
Статтю призначено визначенню предмета кримінальних правопорушень, передбачених ст. 191 КК України. В ній проаналізовано відображені в науковій літературі підходи щодо трактування такого предмета, правові позиції Верховного Суду із цього питання, і на їх основі зроблені певні авторські висновки. Звертається увага на трьох проблемних аспектах: тлумаченні змісту понять «майно, яке було ввірене особі» та «майно, що перебувало у віданні особи» і їх розмежуванні; визначенні предмета привласнення і розтрати чужого майна шляхом зловживання службовою особою своїм службовим становищем; визначенні предмета заволодіння чужим майном шляхом зловживання службовою особою своїм службовим становищем. The article is intended to define the subject of criminal offenses provided in Art. 191 of the Criminal Code of Ukraine. It analyzes the approaches to the interpretation of such a subject reflected in the scientific literature, the legal positions of the Supreme Court on this issue. Certain author's conclusions are drawn based on the analyses of the approaches. Attention is paid to three problematic aspects: interpretation of the meaning of the concepts "property entrusted to a person" and "property given to a person" and their distinction; determining the subject of appropriation and embezzlement of someone else's property by official’s abuse of his official position; defining the subject of acquisition of someone else's property by official’s abuse of official position.
