Abstract
У статті запропоновано розгляд права курдської нації на самовизначення через аналіз джерел міжнародного права, які гарантують право кожної нації на самовизначення, та окремих положень теорії державного суверенітету, а також визначення найбільш прийнятної форми реалізації такого права через ана- ліз ситуації, що склалася на території етнічного Курдистану на цей момент. Обґрунтовано висновок, що відповідно до норм міжнародного права і з огляду на ситуацію із систематичними утисками, курди мають право на створення власної держави. Констатовано: якщо незалежність Курдистану буде все-таки відстояна, то необхідною умовою набуття статусу суб’єкта міжнародного права є міжнародне визнання. The article suggests a view on the right of Kurdish nation to self-determination by analysis of sources of international law that guarantee the right of each nation to self-determination and certain provisions of the state sovereignty theory, as well as determining the most acceptable form for the realization of such a right by analysis of the situation that has developed in the territory of ethnic Kurdistan at the moment. The conclusion is justified that according to the norms of international law and taking into account the situation with systematic oppression, the Kurds have the right to establish their own state. It was stated that if the independence of Kurdistan is still settled, the necessary condition for acquiring the status of international law subject is international recognition.
