Abstract
У статті визначається сутність презумпції невинуватості як гарантії права на справедливий судовий розгляд. Зауважується, що презумпція невинуватості є комплексною засадою кримінального провадження. Структурні елементи презумпції невинуватості запропоновано об’єднати в такі групи: правила доведеності вини (обов’язок обвинувача щодо доказування вини; тлумачення сумнівів на користь підозрюваного, обвинуваченого; доведення винуватості поза розумним сумнівом); наявність вироку суду (остаточне та обґрунтоване рішення); правила поводження з підозрюваним, обвинуваченим чи виправданим (правила оприлюднення інформації та публікацій у засобах масової інформації, наявність компенсаторного механізму, відповідне ставлення до особи). The article defines the essence of the presumption of innocence as a security of the right to a fair trial. It is noted that the presumption of innocence is a complex principle of the criminal proceeding. It is proposed to consolidate the structural elements of the presumption of innocence into the following groups: rules of the proof of guilt (the duty of the prosecutor to prove the guilt; interpretation of doubts in favor of the suspect or accused; proof of guilt beyond a reasonable doubt); the presence of a court sentence (a final and reasonable judgment); rules for the treatment of a suspect, accused or acquitted (the rules of disclosing the information and publications in the media, the availability of a compensatory mechanism, appropriate treatment of a person).
