Abstract
Праця є першим монографічним дослідженням, присвяченим запобіганню та врегулювання конфліктів інтересів в діяльності публічної адміністрації. У ній представлено авторський погляд на сутність та структуру конфліктів інтересів, їх види, наведено визначення відповідних детермінант, із позиції правового розуміння: розкрито генезис становлення та розвитку дослідження проблем запобігання та врегулювання конфлікту інтересів; досліджено поняття та складові елементи адміністративно-правового механізму запобігання та врегулювання конфлікту інтересів в діяльності публічної адміністрації. У дослідженні також розкриті засоби запобігання та врегулювання конфлікту інтересів у публічних правовідносинах, а також особливості запобігання та врегулювання конфліктів інтересів в діяльності центральних органів виконавчої влади, що спрямовуються та координуються Кабінетом Міністрів України через Міністра внутрішніх справ України. Окрему увагу приділено адміністративній відповідальності за правопорушення у цій сфері. Охарактеризовано міжнародний досвід, а також визначено напрямки вдосконалення правового регулювання запобігання та врегулювання конфліктів інтересів в діяльності публічної адміністрації. Роботу адресовано фахівцям-теоретикам, які займаються дослідженнями в галузі адміністративного права та процесу, а також науково-педагогічним працівникам, аспірантам, студентам закладів вищої освіти, особам, уповноваженим на виконання функцій держави або місцевого самоврядування, та особам, прирівняних до них, а також усім небайдужим до проблем запобігання та протидії корупції.. The work is the first monographic study devoted to the prevention and settlement of conflicts of interest in the activities of public administration. It presents the author's view on the essence and structure of conflicts of interest, their types, defines the relevant determinants, from the standpoint of legal understanding: the genesis of the formation and development of research on the prevention and settlement of conflicts of interest is revealed; the concept and constituent elements of the administrative-legal mechanism of prevention and settlement of conflict of interests in the activity of public administration are studied. The research also reveals the means of preventing and resolving conflicts of interest in public legal relations, as well as the specifics of preventing and resolving conflicts of interest in the activities of central executive bodies, which are directed and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Internal Affairs of Ukraine. Special attention is paid to administrative responsibility for offenses in this area. The international experience is characterized, as well as the directions for improving the legal regulation of the prevention and settlement of conflicts of interest in the activities of the public administration. The work is addressed to theoretical specialists engaged in research in the field of administrative law and process, as well as scientific and pedagogical workers, graduate students, students of higher education institutions, persons authorized to perform the functions of the state or local self-government, and persons equated to them, as well as to everyone who cares about the problems of preventing and combating corruption.
