Abstract
У статті проведено аналіз становлення інституту детективів в системі Національної поліції України. Зазначається, що діяльність підрозділів детективів НАБУ показує, що детектив як особа, яка здійснює оперативно-розшукову та кримінально-процесуальну діяльність може функціонувати в реаліях кримінального процесуального законодавства України. Проводиться аналіз наукових поглядів працівників оперативних підрозділів щодо реформування системи кримінальної поліції, впровадження інституту детективів та внесення змін до законодавчих актів. З’ясовано, що основною причиною слабкої ефективності впровадження інституту детективів в Національній поліції шляхом проведення експерименту, зокрема: відсутність законодавчого підкріплення діяльності детективів у системі Національної поліції; відсутність нормативного закріплення повноважень щодо проведення оперативно-розшукової та кримінально-процесуальної діяльності одним суб’єктом; неякісне підхід до визначення підрозділів, в яких проводився експеримент; неповноцінна підготовка працівників, які працювали в підрозділах детективів. The article analyzes the formation of the institute of detectives in the system of the National Police of Ukraine. It is noted that the activity of NABU detective units shows that a detective as a person who carries out operative-investigative and criminal-procedural activities can function in the realities of the criminal procedural legislation of Ukraine. An analysis of the scientific views of the operative units regarding the reform of the criminal police system, the introduction of the institute of detectives, and the introduction of changes to legislative acts is carried out. It was found that the main reason for the weak effectiveness of the introduction of the institute of detectives in the National Police by conducting an experiment, in particular: the lack of legislative reinforcement of the activity of detectives in the system of the National Police; lack of regulatory consolidation of powers to conduct investigative and criminal procedural activities by one entity; a poor-quality approach to determining the units in which the experiment was conducted; inadequate training of employees who worked in detective units.
