Abstract
Стаття присвячена окремим аспектам діяльності Суду Європейського Союзу щодо захисту від дискримінації. Проаналізовано зміни трактування «рівності» та «недискримінації» у практиці Суду ЄС та охарактеризовано функціонування принципу рівності. Автор акцентує увагу на тому, що визнання Судом ЄС принципу рівності одним із загальних принципів права ЄС, а недискримінації принципом права та частиною «основоположних прав людини», які він покликаний захищати, не спричиняє неузгодженостей, а навпаки дає уявлення про конкретне застосування загального принципу рівного ставлення. The article is dedicated to certain aspects of the Court of the European Union activity concerning protection against discrimination. The changes in the interpretation of “equality” and “non-discrimination” in the practice of the EU Court are analyzed and the functioning of the principle of equality is described. The author emphasizes that recognition of the principle of equality by the EU Court as one of the general principles of EU law, and the non-discrimination as the principle of law and the part of “fundamental human rights”, which the Court is intended to protect, does not lead to inconsistencies, but rather gives an idea of the concrete application of the general principle of equality.
