Abstract
У статті досліджено публічно-правові принципи державної реєстрації речових прав на нерухоме майно та їх обтяжень. Визначено, що необхідність проведення державної реєстрації прав на нерухоме майно та угод із ним (як обов’язкова вимога до операцій, що здійснюються з нерухомістю) переслідує кілька цілей: надати відкритість (прозорість) правам на нерухоме майно, а також інформації про ці права; запровадити державний контроль за вчиненням правочинів із нерухомим майном (переходом прав на нього), чим максимально захистити права та законні інтереси громадян та юридичних осіб; внести однаковість у процедуру реєстрації прав на нерухоме майно на всій території України. The article examines the public-legal principles of state registration of real rights to immovable property and their encumbrances. It is determined that the need for state registration of rights to immovable property and transactions with it as a mandatory requirement for transactions carried out with real estate, pursues several goals: to provide openness (transparency) of rights to immovable property, as well as information about these rights; to introduce state control over the implementation of transactions with immovable property (transfer of rights to it) and thereby to protect the rights and legitimate interests of citizens and legal entities as much as possible; introduce uniformity in the procedure for registering rights to immovable property throughout Ukraine.
