Item Проблемні питання початку досудового розслідування. Issues Related to Commencement of Pre-Trial Investigation(2016) Удалова, Лариса Давидівна; Udalova, LarysaДосліджено актуальні проблеми початку досудового розслідування. Вказано на необхідність удосконалення його правового регулювання щодо визначення порядку прийняття заяв та повідомлень про кримінальні правопорушення, форми процесуального рішення про початок досудового розслідування, визначення строків і процесуальних засобів перевірки заяви чи повідомлення про кримінальне правопорушення. Запропоновано зміни та доповнення до кримінального процесуального законодавства України. Исследованы актуальные проблемы начала досудебного расследования. Указано на необходимость совершенствования его правового регулирования в части определения порядка принятия заявлений и сообщений об уголовных правонарушениях, формы процессуального решения о начале досудебного расследования, определения сроков и процессуальных средств проверки заявлений и сообщений об уголовном правонарушении. Предложены изменения и дополнения к уголовному процессуальному законодательству Украины. The article investigates the relevant problems of the commencement of pre-trial investigation. The focus is placed on the need to improve the legal regulation of the beginning of preliminary investigation to determine the procedure for acceptance of statements and notices about criminal offenses, forms of procedural decision on commencement of pre-trial investigation, determination of deadlines and procedural means for verification of a statement or notice on a criminal offense. The need to complement the Code of Procedural Law of Ukraine with Article 2131, «Procedure of accepting the statements and notices on criminal offenses and their verification», which should secure the provision that the individuals or legal entities shall be entitled to inform the investigator or authorized officer about the committed criminal offense in writing, orally or otherwise, was substantiated.Item Запобігання торгівлі людьми оперативними підрозділами національної поліції України. Сформульовано пропозиції щодо вдосконалення цієї діяльності. Раскрыты особенности деятельности оперативных подразделений Национальной полиции Украины по предотвращению торговли людьми. Сформулированы предложения по совершенствованию данной деятельности. The author has discovered features of activities of operational departmentsof the National Police of Ukraine related to prevention of humantrafficking and has also provided suggestions for their improvement in his article. The strategy of combating human trafficking is revealed: а) raising thelevel of awareness of thepublic, women at risk; b) the improvement of the legislation and law enforcement actions; c) aid to victims and potential victims. Preventive activities of the emergency unit of the Operational Departments of the National Police of Ukraine in preventing human trafficking is carried out in three main areas: а) activities aimed at preventing the commission of causal facts of human trafficking; b) activities directed to prevent the commission of trafficking by others, similar to the one investigated; c) prevention of «probable» evidence of trafficking, which can be performed under certain conditions (not allidentifiedmembers of a criminal group can start a new criminal activity).Item Взаємодія оперативних підрозділів зі службами банківської безпеки у протидії шахрайству в сфері кредитування. Розглянуто окремі аспекти взаємодії оперативних підрозділів зі службами банківської безпеки щодо протидії шахрайству під час здійснення кредитних операцій банків в Україні. Доказано, что политические и социально-экономические изменения, происходящие в Украине, влияют на качественные характеристики преступности, особенно на такой вид преступления, как мошенничество в сфере кредитования. Рассмотрены некоторые аспекты взаимодействия оперативных подразделений со службами банковской безопасности при противодействии мошенничеству во время осуществления кредитных операций банков в Украине. Political and socio-economic changes taking place in Ukraine, affecting the quality characteristics of crime, especially in such kinds of offenses as frauds with the credit operations of banks are analyzed in the article. It covers some aspects of the interaction of the operative units with bank security services at combating frauds in the sphere of credit operations of banks in Ukraine. The establishment of Ukraine as an independent state parallel to the processes of formation of the legal system and the development of the market economy has led to the inefficiency of the state regulation of the latter, as well as the emergence of the powerful shadow economy because of significant gaps in legislative and regulatory acts.Item Здійснення кримінальною поліцією профілактики звідництва. Висвітлено правові аспекти правоохоронної діяльності в цій сфері. Розроблено рекомендації для оперативних працівників стосовно профілактики цих злочинів. Рассмотрены вопросы осуществления профилактики сводничества для разврата подразделениями криминальной полиции в современных условиях. Освещены правовые аспекты правоохранительной деятельности в данной сфере. Разработаны рекомендации для оперативных работников по профилактике таких преступлений. The main criterion of the work of the National police should be confidence of peoplein them. It depends on many factors, particularly the openness of their employees, cooperation with public and non-governmental organizations, as well as the sincerity of intentions to help people who suffer from unlawful acts. However, in our opinion, the best way isto help such people toavoid committing a crime that would stop onset of socially dangerous consequences. To this end, law enforcement bodiesare engaged in crimeprevention. The Peculiarities of Interrogating a Person Suspected of Illegal Actions with the Equipment Used for Manufacturing Drugs and Psychotropic Substances.(2016) Рівчаченко, Олена Анатоліївна; Rivchachenko, OlenaРозкрито окремі тактичні особливості проведення допиту підозрюваного в незаконних діях з обладнанням, що використовувалось для виготовлення наркотиків. Визначено перелік питань, які належить встановити під час здійснення цієї слідчої (розшукової) дії. Надано пропозиції щодо підвищення її ефективності. Раскрыты некоторые тактические особенности допроса подозреваемого в незаконных действиях с оборудованием, которое использовалось для изготовления наркотиков. Определен перечень вопросов, требующих установления при осуществлении данного следственного (розыскного) действия. Внесены предложения по повышению его эффективности. In the article some tactical peculiarities of interrogation of a person suspected of illegal actions with the equipment used for drugs and psychotropic substances manufacturing are disclosed. Special attention is paid to determination of question list requiring to be established during performance of this investigative action and also some proposals aimed at improving its efficiency are conducted.
