Item ОБ’ЄКТИ ПОШУКОВОЇ ДІЯЛЬНОСТІ ОПЕРАТИВНИХ ПІДРОЗДІЛІВ.Оbjects of Operatives’ Search Activity(2018) Шаповалов, О. О.; Shapovalov, O.Розглянуто проблемні питання, пов’язані з пошуком даних про об’єкти матеріального світу (що становлять оперативний інтерес), які водночас є об’єктами пошукової діяльності оперативних підрозділів. Визначено та науково обґрунтовано класифікацію об’єктів пошукової діяльності оперативних підрозділів як процесу виявлення осіб і фактів, що становлять оперативний інтерес. Зазначено, що пошукова діяльність передбачає дві форми: елемент (стадія) будь-якої пізнавальної діяльності; система організації, що має особливу правову сутність, підстави та принципи організації. З’ясовано, що об’єктом пошукової діяльності є не всі предмети та документи, а лише ті, що мають ознаки злочину, можуть бути зафіксовані й надалі використані під час досудового розслідування. Проаналізовано теоретичні засади оперативного пошуку як засобу збирання інформації про об’єкти пошукової діяльності на підставі діалектичного підходу.Article analyzes topical issues connected to search of data regarding the material objects (objects of special operative interest), simultaneously presented as objects of operative units’ search activity. Definition and scientific justification is provided for classification of objects of operative units’ search activity as a process aimed at detection of persons and facts as objects of special operative interest. It is noted that search activity comprises two elements: stage of any cognitive activity; organization system with specific legal nature, grounds and principles. As an organization system it is characterized by some special features distinguishing it from other operative activities, including structured division of its areas: search of persons who prepare, commit or have already committed a crime; search of items and documents which may prove the fact of crime preparation or commission.Item УЧАСТЬ СПЕЦІАЛІСТА В ПРОВЕДЕННІ ДОПИТУ ПІД ЧАС РОЗСЛІДУВАННЯ НЕНАЛЕЖНОГО ВИКОНАННЯ ПРОФЕСІЙНИХ ОБОВʼЯЗКІВ МЕДИЧНИМ АБО ФАРМАЦЕВТИЧНИМ ПРАЦІВНИКОМ.Participation of a Specialist in Interrogation when Investigating of Improper Performance of Professional Functions by a Medical or Pharmaceutical Worker(2018) Таранова, А. Визначено основні питання, які ставлять слідчі під час допиту.In the article entitled «Participation of a specialist in interrogation when investigating of improper performance of professional functions by a medical or pharmaceutical worker» we are talking about the possibility of using specialistʼs knowledge during the preparation and conducting of interrogation. Визначено роль інформаційного забезпечення в процесі проведення експертизи холодної зброї, окреслено основні тенденції його розвитку.In the articles considered methodical and organizational aspects constrained with the use of modern information technologies for the increase of effectiveness of realizations criminalistics researches and efficiency of drawing on the got results in the process of opening and investigation of crimes. Worked out practical recommendations and suggestions which assist the effective use the criminal specialistlawyer of informative CASS for the informative providing forensic examination researches. Обґрунтовано ефективність комплексної методики психологічного забезпечення процесу формування професійно компетентних працівників системи органів Національної поліції. Зʼясовано стадії становлення професійної компетентності працівника підрозділів патрульної поліції. Сформульовано комплекс вимог до професійної компетентності та професіоналізму поліцейських.The professional competence of the patrol policeman consists of personality traits, professional skills and knowledge, experience, skills, abilities and motivations. The work of practical psychologists and the governance of the National Police units is aimed at patrol preparation as a professional, taking in to account the component composition of all competencies. Акцентовано увагу на субʼєктивних та обʼєктивних чинниках, що позначаються на перебігу й результатах допиту потерпілого, сприяють встановленню необхідного психологічного контакту з особою. Розглянуто тактичні прийоми, які використовує слідчий з метою отримання повних і достовірних показань. Запропоновано дієві рекомендації щодо ефективного та якісного проведення допитів потерпілих під час розслідування грабежів.In the articles exposed psychological aspects of realization of interrogation the victim are during investigation of robberies. Attention is accented on human and objective factors, that influence on motion and results of interrogation the victim, and also assist establishment of necessary psychological contact with a person. Здійснено комплексне дослідження проблем організації прокурорського нагляду за проведенням контрольованої поставки, контрольованої та оперативної закупки товарів, предметів і речовин, визначено сутність та правовий зміст зазначеної негласної слідчої (розшукової) дії, особливості її організації. Сформульовано пропозиції щодо вдосконалення кримінального процесуального законодавства України, організаційних засад прокурорського нагляду за проведенням контрольованої поставки, контрольованої та оперативної закупки товарів, предметів і речовин.The Prosecutorʼs Office of Ukraine plays an important role in the fight against crime, since one of the tasks of the prosecutorʼs office is to facilitate the disclosure of criminal offenses, the protection of the individual, his rights, freedoms, property, the rights of enterprises, institutions, organizations from criminal encroachments, implementation of measures to prevent criminal offenses, elimination causes and conditions conducive to their commission. Проаналізовано наявні в юридичній літературі позиції щодо цього питання та слідчу практику розслідування кримінальних проваджень зазначеної категорії.The article deals with the use of special knowledge in conducting an investigative experiment, analyzed the procedural status of a specialist and the mechanism for its involvement. In order to fulfill the tasks of criminal justice, the criteria for the use of special knowledge in the course of carrying out this investigative action have been determined. The activity of a specialist proceeds within the scope of the investigator’s authority when applying special knowledge to him. A specialist in the conduct of an investigative experiment acts as an assistant investigator in the solution of a number of specialized knowledge that requires professional knowledge of the special knowledge and skills of their application and do not require expert research.
