Abstract

Дисертація на здобуття наукового ступеня доктора юридичних наук за спеціальністю 12.00.01 – теорія та історія держави і права; історія політичних і правових учень. – Національна академія внутрішніх справ Міністерства внутрішніх справ України, Київ, 2021. У дисертації здійснено комплексне дослідження конституційно-правових засад створення і діяльності органів державної влади та управління радянської України в 1920–1930-х роках. На підставі аналізу сучасних методологічних підходів, архівних матеріалів розкрито особливості формування органів державної влади та управління відповідно до Конституції УСРР 1919 року, Конституції УСРР 1919 року в редакції 1925 року та Конституції УСРР 1929 року, зокрема Всеукраїнського з’їзду рад, Всеукраїнського центрального виконавчого комітету, Ради народних комісарів УСРР, а також народних комісаріатів, Уповноважених народних комісаріатів РСФРР в радянській Україні та місцевих органів радянської влади. Охарактеризовано законотворчу діяльність вищих органів державної влади та управління радянської України в 1920–1930-х роках, а також її етапи та стадії; досліджено структуру, форми та методи їх функціонування. The thesis for Doctor of Legal Sciences on a Specialty 12.00.01 – Theory and History of State and Law; History of Political and Legal Doctrines. – National Academy of Internal Affairs of the Ministry of Internal Affairs of Ukraine, Kyiv, 2021. In the dissertation the complex research of constitutional and legal bases of creation and functioning of bodies of the government and management of the Soviet Ukraine in 1920-1930th is carried out. Based on the analysis of modern methodological approaches, archival materials revealed the peculiarities of the formation of public authorities and administration in accordance with the Constitution of the USSR in 1919, the Constitution of the USSR in 1919 as amended in 1925 and the Constitution of the USSR in 1929, including the All-Ukrainian Congress, All-Ukrainian Central Executive Committee. Councils of People’s Commissars of the USSR, as well as People’s Commissariats, Plenipotentiaries of the People’s Commissariats of the RSFSR in Soviet Ukraine and local Soviet authorities. The legislative activity of the highest bodies of state power and administration of Soviet Ukraine in the 1920s and 1930s, as well as its steps and stages are described; the structure, forms and methods of their functioning are investigated.
