Abstract
Дисертація є самостійним завершеним науковим дослідженням правового режиму нерухомого майна членів сім’ї. Вивчено стан наукової розробки питання правового режиму нерухомого майна членів сім’ї, досліджено процес становлення та розвитку регулювання правового режиму нерухомого майна членів сім’ї та зарубіжний досвід у цій сфері. Здійснено загальну характеристику правового режиму нерухомого майна членів сім’ї. Розглянуто поняття нерухомого майна та членів сім’ї, запропоновано поняття правового режиму нерухомого майна членів сім’ї як комплексу правових засобів, спрямованих на регулювання відносин, що виникають у процесі володіння, користування і розпорядження нерухомим майном такими особливими суб’єктами, як члени сім’ї. Визначено та охарактеризовано види правового режиму нерухомого майна членів сім’ї.Окрему увагу приділено правовому режиму таких видів нерухомого майна як житло та об’єкт незавершеного будівництва, а також особливостям правового режиму нерухомого майна членів сім’ї, набутого на різних правових підставах (приватизація, цивільно-правові договори).Надаються науково обґрунтовані пропозиції щодо внесення змін до законодавства України з метою вдосконалення правового режиму нерухомого майна членів сім’ї.The dissertation is a completed independent research of legal regime for the real estate of family members. The state of scientific development of the legal regime for the real estate of family members is examined, the process of formation and development of the regulation of legal regime for the real estate of family members and international experience in this field were explored. General characteristic of the legal regime for the real estate of family members is provided. Concepts of the real estate and family members are considered; author offers the concept of legal regime for the real estate of family members as a complex of legal means to regulate the relations arising in the possession, use and disposal of real estate by such specific subjects as family members. Types of the legal regime for the real estate of family members are determined and characterized.
Special attention is paid to the legal regime of such types of real estate as housing and construction in progress, and the peculiarities of the legal regime for the real estate of family members acquired on different legal grounds (privatization, civil contracts).Scientifically justified proposals to amend the legislation of Ukraine in order to improve the legal regime for the real estate of family members are given.
