Abstract
Дисертація присвячена комплексному дослідженню фінансово-правового регулювання валютного контроля в Україні.
У роботі проаналізовано систему валютного регулювання та контролю в Україні з початку її створення до її сучасного стану, визначено основні недоліки її функціонування та розроблено теоретичні рекомендації щодо вирішення найпроблематичніших питань. Особлива увага приділяється аналізу ефективності застосованих інструментів валютного контролю в Україні на різних етапах розвитку економіки. Також визначено поняття та значення валютного контролю, розглянуто погляди науковців щодо тлумачення сутності валютного контролю та внесено ряд пропозицій щодо вдосконалення валютного контролю як складової системи валютного регулювання.
Визначено механізм валютного контролю як систему взаємопов’язаних елементів, таких, як суб’єкт, об’єкт і методи контролю, за допомогою яких реалізується мета, завдання та функції останнього. Аналізуються окремі елементи механізму валютного контролю та їх закріплення в чинному законодавстві України.
Розкрито проблему статусу контролюючих суб’єктiв валютного контролю. На основi аналiзу лiтератури й законодавства дослiджуються повноваження та функцiї контролюючих органiв у валютнiй сферi.
Досліджено сутність відносин у сфері валютного контролю, еволюцію систем валютного контролю в країнах із розвинутою економікою, проаналізовано українське валютне законодавство. Визначено актуальні напрямки удосконалення системи валютного контролю в Україні.
The dissertation is devoted to the complex research of the financial and legal provision of currency control in Ukraine.
The dissertation examines the system of currency regulation and control in Ukraine from the beginning of its creation to its current state, defines the main shortcomings of its functioning and develops theoretical recommendations for solving the most problematic issues. Particular attention is paid to the analysis of the effectiveness of the instruments of currency control in Ukraine at different stages of economic development. The paper describes of the notion and significance of the exchange control is made, in addition, the scholars views on interpretation of the essence of the exchange control are analyzed, moreover, a number of propositions for improving exchange control as a part of exchange regulation is made.
The dissertation examines the mechanism of currency control as a system of interrelated elements, such as subject, object and methods of control, with the help of which the goal, tasks and functions of the latter are realized. The author analyzes certain elements of the mechanism of currency control and their consolidation in the current legislation of Ukraine. The problem of the supervisory subjects’ of currency control status is analyzed in the paper. On the basis of the literature and legislation analysis the powers and functions of the supervisory authorities in the currency sphere, and proposals are made to improve the legislation in the sphere of currency control.
This dissertation explores the essence of relations in the field of currency control, the evolution of currency control systems in countries with developed economies, and analyzes Ukrainian currency legislation. Actual directions of modern system of currency control in Ukraine are determined.
